Minutes of November Monthly Meeting of Sligo Borough Council held in the Council Chamber, City Hall, Sligo on Monday 9th November, 2009 at 8.00 pm.

1. SUSPENSION OF STANDING ORDER

On the proposal of Councillor Declan Bree and seconded by Councillor Tony McLoughlin it was unanimously agreed to suspend Standing Orders to allow members to express their wishes to Mr. Seamus Finn, editor of the Sligo Champion for a long and happy retirement.

Members also offered congratulations to Mr. Tommy Gorman, Northern Editor with RTE, who was recently presented with an Honorary Doctorate from NUI, Galway.

The congratulations of the Council was also extended to Sligo Rovers on reaching the finals of the FAI Ford Cup and wished them every success on the 22nd November 2009.

2. CONFIRMATION OF MINUTES

On the proposal of Councillor David Cawley seconded by Councillor Veronica Cawley minutes of meetings been

  • Programme 4.5.8 committee meeting of 28th October 2009

were unanimously adopted and signed by the Mayor.

3. MATTERS ARISING

Councillor Chris MacManus raised the issue of the development of the Fairgreen.  As the Fairgreen was listed later on the November Agenda, no discussion took place at this time.

A copy of the legal advice received from Hegarty and Armstrong Solicitors regarding the Coat of Arms was circulated to Members.  The County Manager informed members that there was no intention to undermine or diminish the Borough Council Coat of Arms.  He said it will retain its present status on headed paper, signage, stationery and websites.

Councillor Declan Bree stated that there was no matters arising regarding the filling of the post of Town Clerk.

4. BUDGET MEETING 2010

It was unanimously agreed to hold 2010 Budget Meeting on 11th January, 2010.

5. DISPOSAL OF A SITE AT SEAVIEW PARK, KNAPPAGHNORE

On the proposal of Councillor Arthur Gibbons seconded by Councillor Jude Devins it was agreed to consent to the disposal of a site at Seaview Park, Knappaghmore to the ESB for the provision of an Electricity Supply to the Knappaghmore Housing Scheme.

6. TAKING IN CHARGE OF ROADS, FOOTPATHS AND OPEN SPACES IN THE FERNDALE HOUSING ESTATE

On the proposal of Councillor Tony McLoughlin seconded by Councillor Chris MacManus it was agreed “That Sligo Borough Council, being satisfied that the road is of general public utility, declares the following road as a Public Road in accordance with Section 11 (1) of the Roads Act 1993” road situate in the housing estate of Ferndale, Cairns Road, Sligo and further that Sligo Borough Council take in charge “Ferndale Housing Estate” Cairns Road, Sligo”

7.   FREEDOM OF THE BOROUGH OF SLIGO

It was unanimously agreed to confer Freedom of the Borough of Sligo on Mr.John McNabola on November 25th at 8.00pm.

8. BALLYTIVNAN RECREATIONAL AREA

Councillor Arthur Gibbons proposed, Councillor Jude Devins seconded and it was agreed to approve in accordance with Part XI of the Planning and Development Act 2000, as amended and Part 8 (Article 81) of the Local Government (Planning and Development) Regulations, 2001 (as amended by the Planning and Development Regulations, 2006) the proposed development of the Ballytivnan Recreation area.

9.  FAIRGREEN PARK

Councillor Chris MacManus proposed, Councillor Declan Bree seconded and it was agreed to approve in accordance with Part XI of the Planning and Development Act 2000 and Part 8 of the Local Government (Planning and Development) Regulations, 2001 (as amended by the Planning and Development Regulations, 2006) the proposed development of the Fairgreen Park

10. MARKIEVICZ BRIDGE AND FOOTBRIDGE SCHEME

Councillor Arthur Gibbons proposed, Councillor Matt Lyons seconded and it was agreed to approve in accordance with Part XI of the Planning and Development Act 2000 and Part 8 of the Planning and Development Regulations 2001, proposed enhancement works of the Markievicz Bridge and Footbridge Scheme

11. ABBEY STREET CAR PARK

In response to a request from members at the October monthly meeting, a further report detailing costs to maximise the number of car parking spaces and improve the overall appearance of the Abbey Street Car Park, was circulated to members.  It was proposed by Councillor Tony McLoughlin, seconded by Councillor Jim McGarry and agreed to incur expenditure required to carry out the works in the sum of €65,000 and to fund same from Development Levies.

12. ADELAIDE STREET CAR PARK

A report was circulated to members on the proposed construction of the Adelaide Car Park. It was proposed by Councillor Sean MacManus, seconded by Councillor Veronica Cawley to incur the expenditure of €168,000 required to carry out the works and to fund same from Development Levies.

13. DEVELOPMENT LEVIES

Members noted report on Development Levies.

14. DEFERRAL OF MOTIONS

Motion number 13 was deferred.

15. NOTICE OF MOTIONS

On the proposal of Councillor Veronica Cawley, seconded by Councillor Declan Bree it was unanimously agreed“That this council appoint independent legal advice for the council members for the full term of the council 2009-2014 for council related matters in consultation with the council members and that this is finalised within two months and all members notified of contact details of the legal advice appointed”

A discussion took place on the Motion.  The County Manager agreed to give the matter further consideration and to investigate the possibility of putting in place a panel of legal advisors with Local Government expertise to assist members.

On the proposal of Councillor Tony McLoughlin, seconded by Councillor Chris Mac Manus and it was unanimously agreed “That Sligo Borough Council provide toilet facilities at Doorly Park Play Ground”

16. SYMPATHY

The sympathy of the Council was extended to the following:

Mrs Breege Kilcullen, Cedar Drive on the death of her son Rory.
Mrs Sally McGloin, Woodtown Lodge on the death of her husband Frankie.


This concluded the business of the meeting which ended at 10.15pm
